Terms and Conditions

1. General

These Terms and Conditions apply to all orders, quotations, and services provided by TMK Signs. By placing an order, the customer agrees to be bound by these terms.

2. Quotations

• All quotations are valid for 28 days from the date issued unless otherwise stated.
• Prices are subject to change if project specifications are altered after acceptance.
• Quotes are based on the information provided; any additional work or changes may incur extra charges.

3. Orders & Deposits

• A deposit is required to confirm all orders.
• All deposits are strictly non-refundable under any circumstances.
• Production will not begin until the deposit has been received and cleared. TMK Signs cannot be held liable for any delays caused in production as a result of delays in a deposit being paid.
• For any order under the value of £3000, a 70% deposit is due before any production is commenced. For any order over the value of £3000, a 50% deposit is due before any production is commenced. These deposit amount may be amended on a case by case basis.

4. Payments

• The remaining balance must be paid in full prior to installation, delivery, or collection unless otherwise agreed in writing.
• All good remain the property of TMK Signs until payment is cleared in full.
• TMK Signs reserves the right to withhold goods or services until full payment is received.
• TMK Signs reserves the right to remove, repossess or initiate debt collection proceeding for unpaid balances.

5. Design & Proof Approval

• Design proofs will be provided where applicable.
• It is the customer’s responsibility to provide a clear, accurate and final representation of their desired artwork and designs. Each order will be subject to a 2 time artwork revision policy and any further revisions may be chargeable. 
• It is the customer’s responsibility to carefully check all artwork, including spelling, dimensions, colours, and layout.
• Once artwork is approved, TMK Signs reserves the right to refuse a change in artwork or specification unless the customer is willing to accept a new quotation for the amended artwork and any subsequent charges incurred.
• Once approval is given, TMK Signs accepts no responsibility for errors.

6. Production & Lead Times

• Lead times are estimates only and may vary depending on workload, materials, and external factors.
• TMK Signs will not be liable for delays caused by circumstances beyond its control.

7. Installation

• Customers must ensure that the installation site is safe, accessible, and ready.
• Any additional work required due to site conditions may incur extra charges.
• Customers must ensure that their customers are aware of the lack of access to their premises during installations and prevent any disruption to the installation.
• TMK Signs is not responsible for damage caused by unsuitable surfaces or pre-existing structural issues.

8. Cancellations

• Orders cannot be cancelled once production has started.
• In the event of an order cancellation, the customer may be liable for the cost of any meetings and consultations carried out.
• If cancellation is requested before production, the deposit will still remain non-refundable and the customer may be liable for additional fees to cover any consequential losses incurred.

9. Returns & Refunds

• Due to the custom nature of signage and printed products, items are non-returnable.

10. Liability

• TMK Signs’ liability is limited to the value of the goods or services provided.
• We are not liable for any indirect, consequential, or financial losses.
• The customer is liable for ensuring that their requested products are complaint with local governing laws.

11. Warranty

• Any warranty provided is limited to manufacturing defects only.
• Damage caused by misuse, weather conditions, improper installation, or normal wear and tear is not covered.

12. Intellectual Property

• All designs, artwork, and concepts remain the property of TMK Signs unless otherwise agreed in writing.
• Customers must ensure they have the right to use any logos, images, or content supplied.

13. Force Majeure

• TMK Signs shall not be held responsible for failure or delay in performance due to events beyond its control, including but not limited to natural disasters, strikes, or supply chain disruptions.

14. Governing Law

• These terms are governed by the laws of England and Wales.
